My answer to the first question would be purely opinionated, so I'm not sure if I can give an objective answer to that. I'd say the latter, as the moment they split off from the core brain, they already diverged into their own separate person. Second question... It depends. On how long, what they'd be able to do outside of simply existing and waiting, and how severe the crimes really were to justify the choices. Life in prison? Inhumane. They're an AI. Life in prison for them means "basically an absurd amount of time until my systems naturally decay on their own." An actual sentence? I still don't really find the concept appealing. An AI would have fundamentally different perception compared to an organic being's. While they still originated from a human brain, how they perceive the world around them would still be irrevocably changed. Until we know whether their perception of time is either expedited or slowed compared to a human's, I'd kinda jot that one down as possibly inhumane, but could be better than complete suspension.
