OPENING STATEMENT! (standing in the well and gesturing dramatically) may it please the court. good evening, your highblood - opposing counsel - members of the jury. today's case is a story about love... and its absence. earlier this evening, my client was celebrating. she's in love, she's happy - she's a new mother! but there was one person who just couldn't be happy for her. someone whose absence of love turned into hatred for my client and turned into harassment and libel. the defendant in today's case stands before you today charged with emotional damages caused by harassment and libel. what that means for *you,* members of the jury, is that this case, as a civil case, operates on the preponderance standard of evidence. we, the plaintiff, carry the burden of proof - we must prove to you *by a preponderance standard* that the defendant's actions caused Mrs. Teto-Egbert harm. the preponderance standard just means "more likely than not" - (making a scales of justice gesture) fifty percent and even a single feather is enough to make the difference. that means if, at the end of today's trial, you think it is *any* amount more likely than not that the defendant is responsible for emotional damages, you *must* find her liable. thank you
