Most mangakas don't create by the standards set by the empire, as crude and lewd as it sounds — their position in the modern day markets inspire many to continue to create and be as they are. Especially in working around traditional "seme" and "uke" roles and allowing them to be subsersive to reader expecation and offer new perspectives. Most BL exists to go against the system and allows castes and different genders to express and explore something they would never otherwise get to. This is expression, art. To be vile, to be filthy — in a way means to be free. What and what you can't read, what and what you can't create. To be unburdened from those demands.
